APPLICATION FOR A NEW PREMISES LICENCE: PUBLIC HOUSE AND BOTTLED BEER SHOP, 660-662 AYLESTONE ROAD, LEICESTER, LE2 8PR

The Director of Neighbourhood and Environmental Services submits a report on an application for a new premises licence for Public House and Bottled Beer Shop, 660-662 Aylestone Road, Leicester, LE2 8PR.

Minutes:

The Director, Neighbourhoods and Environmental Services, submitted a report that required Members to determine an application for a new premises licence for Public House and Bottled Beer Shop, 660-662 Aylestone Road, Leicester, LE2 8PR.

 

Members noted that a representation had been received in respect of the application, which necessitated that the application had to be considered by Members.

 

The applicant - Mr Kieran Lyons, Chloe Roper – Noise and Pollution Control Officer, the Licensing Team Manager and the Solicitor to the Sub-Committee were all present at the hearing.

 

Introductions were made and the procedure for the meeting was outlined to those present.

 

The Licensing Team Manager presented the report and outlined the details of the application. There were no questions from Members or the Noise and Pollution Team representative.

 

Chloe Roper outlined the reasons for the representation and answered questions from Members.

 

Mr Lyons was then given the opportunity to outline the details of the application, responded to the points made and answered questions from Members. Mr Lyons also requested that additional information in the form of a document (from his Planning Consultant) be accepted by Members in support of his application. There being no objection by Ms Roper, the Sub-Committee agreed to accept the additional information at the hearing.

 

All parties were then given the opportunity to sum up their positions and make any final comments.

 

Prior to Members considering the application, the Solicitor to the Sub-Committee advised Members of the options available to them in making a decision. Members were also advised of the relevant policy and statutory guidance that needed to be taken into account when making their decision.

 

In reaching their decision, Members felt they should deliberate in private on the basis that this was in the public interest, and as such outweighed the public interest of their deliberation taking place with the parties represented present.

 

The Licensing Team Manager, the Solicitor to the Sub-Committee, Mr Lyons and Chloe Roper then withdrew from the meeting.

 

Members then gave the application full and detailed consideration.

 

The Solicitor to the Sub-Committee was then recalled to the hearing to give advice on the wording of the decision.

 

The Licensing Team Manager, Mr Lyons and Chloe Roper then returned to the meeting.

 

The Chair informed all persons present that they had recalled the Solicitor to the Sub-Committee for advice on the wording of their decision.

 

RESOLVED:

 

That the application for a new premises licence for Public House and Bottled Beer Shop, 660-662 Aylestone Road, Leicester, LE2 8PR be granted subject to the conditions consistent with the operating schedule (at appendix C of the report) together with the following additional conditions:

 

1)    Premises to serve until 11.00pm, definite shut at 11.30pm,

2)    Bottle bins should not be emptied between the hours of 6.00pm until 10.00am the following morning,

3)    No off sales after 10.00pm.

 

REASONS FOR THE DECISION

 

The reasons for the additional conditions were for the benefit of the local residents as advised by the Noise Team and to discourage on street drinking.  The off sales were restricted to 10pm to prevent street drinking and because it was felt that the terminal hours should not be the same for on and off sales.
