APPLICATION FOR A NEW PREMISES LICENCE: 215 SCRAPTOFT LANE, LEICESTER

The Director of Neighbourhood and Environmental Services submits a report on an application for a new premises licence: Off-Licence, 215 Scraptoft Lane, Leicester LE5 2HS.

Minutes:

The Director of Neighbourhood and Environmental Services submitted a report that required the sub-committee to determine an application for a new premises licence for 215 Scraptoft Lane, Leicester.

 

The sub-committee noted that a representation had been received which necessitated that the application for a new premises licence had to be considered by the sub-committee.

 

Mr Bhawsar on behalf of the applicant, Mr Kanahalingham the applicant, the Licensing Team Manager, the Solicitor to the sub-committee and an observing solicitor were present.

 

Members of the public were also present.

 

Introductions were made and the procedure for the meeting was outlined to those present.

 

The Licensing Team Manager presented the report and outlined details of the application. It was noted that three representations had been received between 31 July and 3 August 2017 from local residents which related to the licensing objectives of prevention of crime and disorder and the prevention of public nuisance. Concerns were raised that another licensed premise in the area would increase noise nuisance and anti-social behaviour in the local area.

 

It was noted that none of the local residents that had submitted written representations were present and the sub-committee confirmed they would take account of the written representations when considering matters.

 

Mr Bhawsar on behalf of the applicant was then given the opportunity to outline the details of the application, respond to the points made in the written representations and to answer questions from the sub-committee.

 

All parties were then given the opportunity to sum up their positions and make any final comments.

 

Prior to the sub-committee considering the application the Solicitor to the sub-committee advised them of the options available to them in making a decision and the relevant policy and statutory guidance that needed to be taken into account when making their decision.

 

In reaching their decision, the sub-committee felt they should deliberate in private on the basis that this was in the public interest and as such outweighed the public interest of their deliberation taking place with the parties represented present.

 

The Licensing Team Manager, the Solicitor to the sub-committee, the observing solicitor, Mr Bhawsar on behalf of the applicant, Mr Kanahalingham the applicant and members of the public withdrew from the meeting.

 

The sub-committee then gave the application full and detailed consideration.

 

The Solicitor to the sub-committee was then recalled to the hearing to give advice on the wording of the decision.

 

The Licensing Team Manager, observing solicitor, Mr Bhawsar on behalf of the applicant, Mr Kanahalingham the applicant and members of the public then returned to the meeting.

 

The Chair informed all persons present that they had recalled the Solicitor to the sub-committee for advice on the wording of their decision.

 

RESOLVED

1.     That the application for a new premises licence: 215 Scraptoft Lane, Leicester be granted with the conditions consistent with the operating schedule and subject to amendment as follows:

                                                         i.          The licence holder shall operate the Challenge 25 policy where only acceptable proof of age identification shall be required for anyone who appears to be under the age of 25 years

                                                        ii.          The licence holder shall ensure notices are displayed advising customers the Challenge 25 policy is in operation at the premises

                                                      iii.          The licence holder shall ensure a CCTV system is installed and operated at the premises to monitor entrances, exits and the internal premises

                                                      iv.          The licence holder shall ensure that all staff are trained in their responsibilities in alcohol sales and the Challenge 25 policy

                                                       v.          The licence holder shall ensure a log book is kept recording any refusals of alcohol and incidents of crime and disorder and anti-social behaviour on the premises

                                                      vi.          The licence holder shall ensure notices are displayed requesting customers to leave the premises in a quiet manner and to respect the peace of nearby residents

                                                    vii.          The Licence holder shall ensure there is no waste disposal between the hours of 10pm and 9am.

 

In reaching their decision the sub-committee commented that they had considered carefully the application and the written representations and felt that the applicant had demonstrated knowledge of the licensing law and objectives and they agreed the licence should be granted with the conditions consistent with the operating schedule, and subject to the amended condition “that the Licence holder will ensure no waste disposal between the hours of 10pm until 9am
