Purpose:

To accept the receipt of funding from the Government’s Safety Fund for the removal and replacement of the external wall cladding system to improve the fire safety of the building.

 

Decision:

Approve the addition of £9,993k to the Capital Programme funded from the Building Safety Fund grant, to remediate the entirety of the Phoenix Square building.

 

Reasons for the decision:

Under the Building Safety Act, building owners and landlords are responsible for making buildings safe and the first port of call to fund any necessary repairs.

The leaseholder protections in the Building Safety Act came into force on 28 June 2022.

Qualifying leaseholders in England can no longer be charged to remove unsafe cladding systems, and there are legal protections in place for non-cladding costs.
