Purpose:

To amend the General Regulatory Policy to make provision for civil penalties.

Decision:

To adopt and implement the Civil Penalties from 11 December 2019, in the city of Leicester as set out in the report and the Council’s General Regulatory Policy be amended accordingly.

Reasons for the decision:

The Housing and Planning Act 2016 amends the Housing Act 2004 to allow financial penalties, up to a maximum of £30,000, to be imposed by Local Housing Authorities (LHAs) as an alternative to prosecution for certain offences.

 

The adoption of civil penalties applies where the Local Housing Authority (LHA) is satisfied beyond reasonable doubt that a person’s conduct amounts to a relevant housing offence in respect of premises in England, this can be invoked in response to any relevant housing offence committed on or after that date.
